Terms & Conditions

These Terms and Conditions ("Terms") govern your relationship with Altacore N.V., a company registered under the laws of Curaçao (registration number 151002) and operating the Smokace online casino product via https://smokace-game.com, including the Canada-focused environment "Smokace" (collectively, the "Website"). These Terms are effective as of 1 January 2026.

By accessing, registering an account on, or otherwise using the Website, you confirm that you have read, understood, and agree to be bound by these Terms, together with the Privacy Policy, KYC Policy, and Bonus Terms available on the Website. If you do not agree with these Terms, you must not access or use the Website.

The Website is offered from outside Canada under an e-gaming licence issued in Curaçao. The Website is not licensed by any Canadian provincial regulator. In particular, it is not licensed by iGaming Ontario and must not be used by residents of Ontario. If you reside in Canada outside Ontario, you may use the Website only if doing so is lawful under the laws of your province or territory and any other applicable laws that apply to you.

Definitions

In these Terms, unless the context requires otherwise:

  • "Operator", "we", "us", "our" means Altacore N.V., a company registered under the laws of Curaçao, registration number 151002, with its registered address at Dr. Henri Martinus, Willemstad, Curaçao, operating the Website under E-Gaming licence No. 8048/JAZ2019-049 issued by Antillephone N.V. and authorised by the Government of Curaçao.
  • "Website" means the online casino platform branded as "Smokace" and made available at https://smokace-game.com, including its Canada-targeted environment "Smokace", all related pages, subdomains, mobile versions, and any related downloadable software.
  • "User", "you", "your" means any natural person who accesses the Website, creates an account, or uses any services offered on the Website.
  • "Player" means a User who has successfully registered an account and places Bets or otherwise participates in games on the Website.
  • "Account" means a personal user account created by you on the Website for the purpose of accessing games, placing Bets, and using other services.
  • "Bet", "Wager" means any monetary stake or equivalent (including stakes made using Bonus funds) placed by you on a game, event, or other gambling activity offered on the Website.
  • "Bonus" means any promotion, incentive, reward, free spins, free Bet, deposit match, cashback, loyalty reward, or other benefit credited to your Account under promotional campaigns, including those described in the Website's Bonus Terms.
  • "Real Money Balance" means funds that you have deposited into your Account and any winnings derived from such funds, excluding Bonus funds and winnings derived from Bonus funds that have not yet met wagering or withdrawal conditions.
  • "Bonus Balance" means any Bonus funds in your Account and any associated winnings that are subject to wagering or other conditions before they become part of your Real Money Balance.
  • "Games" means online casino games, including slots, table games, live dealer games, and any other gambling products made available on the Website.
  • "Restricted Jurisdiction" means any jurisdiction from which we do not accept Players under these Terms, including the province of Ontario, Canada, and any other territories listed as restricted on the Website from time to time.
  • "KYC" means "Know Your Customer" checks, including identity verification, age verification, source of funds, and other due diligence procedures carried out in accordance with our KYC Policy and applicable anti-money laundering laws.

Account Registration

Eligibility

  • You must be at least 18 years old, or older if required by the laws of your province, territory, or country of residence, to register an Account and use the Website.
  • You confirm that online gambling is legal in your place of residence and that you are permitted by applicable law to participate in online gambling services offered from outside your jurisdiction.
  • Residents of Ontario, Canada, and residents of any other Restricted Jurisdiction are strictly prohibited from registering or using an Account. If you become a resident of a Restricted Jurisdiction, you must immediately stop using the Website and notify us.
  • You may hold only one Account on the Website. Multiple Accounts, whether under the same or different identities, are prohibited and may lead to closure of all related Accounts and forfeiture of funds and Bonuses.

Registration Process

  • To create an Account, you must complete the online registration form on the Website, providing at least your full name, date of birth, country of residence, email address, and a secure password, and any other information requested.
  • By registering, you confirm that:
    • all information you provide is true, accurate, complete, and up to date; and
    • you are acting solely on your own behalf and not on behalf of any third party.
  • We may require you to verify your email address by clicking a confirmation link or entering a verification code sent to the email you provided.
  • We reserve the right to refuse registration, suspend the registration process, or close an Account at our reasonable discretion, subject to these Terms and applicable law.

KYC and Verification

  • We conduct KYC checks in accordance with our KYC Policy and applicable anti-money laundering and counter-terrorist financing regulations.
  • At any time, and in particular before processing withdrawals, we may ask you to provide documents and information, including but not limited to:
    • government-issued photo ID (passport, national ID card, or driver's licence);
    • proof of address (utility bill, bank statement, or similar document);
    • proof of ownership of payment methods used (bank card copy with masked digits, e-wallet screenshots, etc.);
    • evidence of source of funds or source of wealth, where required.
  • If you fail to provide requested KYC information, provide false or misleading information, or if we reasonably suspect fraud, money laundering, or other unlawful activity, we may suspend or close your Account, void Bets, and withhold funds in accordance with applicable law.

Account Security and User Obligations

  • You are responsible for maintaining the confidentiality of your login details, including email address and password, and for restricting access to your devices.
  • You must:
    • not disclose your login details to any third party;
    • immediately notify us if you suspect that your Account has been compromised, accessed without authorization, or used fraudulently; and
    • regularly update your password and use strong, unique credentials.
  • Any activity carried out through your Account using valid login credentials will be deemed to have been carried out by you. We are not liable for losses resulting from unauthorized access due to your failure to protect your credentials.
  • You must not allow any other person, including minors, to access or use your Account.

Betting & Gameplay Rules

General Rules for Placing Bets

  • You may place Bets only using funds available in your Real Money Balance or, where permitted by specific promotions, from your Bonus Balance in accordance with the applicable Bonus Terms.
  • Minimum and maximum Bet limits may apply to specific Games or promotions and are displayed within each Game or promotional description. It is your responsibility to familiarize yourself with any such limits before placing Bets.
  • A Bet is considered accepted once it has been processed by our servers and appears in your transaction history. Once accepted, a Bet cannot generally be cancelled or amended by you.
  • All times and timestamps displayed on the Website are based on the server time, which may differ from your local time. The server time governs the acceptance and settlement of all Bets.

Game Rules and Results

  • Each Game may be governed by specific rules provided by the relevant software provider and/or displayed within the Game interface. By playing a Game, you agree to be bound by those rules in addition to these Terms.
  • Game results are generated by certified random number generators (RNGs) or, in the case of live dealer Games, by live game operations. We use only licensed software providers approved under our Curaçao licence.
  • The outcome shown on our servers is final and binding. In the event of discrepancy between your device display and the server records, the server records shall prevail.

Live Casino and Chat Conduct

  • Where live dealer Games or chat functions are offered, you must behave respectfully and refrain from any abusive, offensive, discriminatory, or harassing language or conduct towards other players, dealers, or staff.
  • Prohibited behaviour includes, without limitation:
    • insults, threats, or hate speech;
    • spamming, advertising, or soliciting other products or services;
    • sharing personal data of yourself or others in chat;
    • discussing or promoting illegal activities.
  • We may mute, restrict, or permanently block your chat access and/or suspend or close your Account for violation of these behaviour rules.

Fraud, Collusion, and Prohibited Practices

  • You must not engage in any activity that:
    • involves fraud, cheating, or exploitation of software bugs or loopholes;
    • uses automated systems, bots, scripts, or software to place Bets or gain an advantage;
    • involves collusion with other players or any attempt to manipulate game outcomes;
    • breaches any applicable laws, including anti-money laundering or sanctions laws.
  • If we reasonably believe that you have engaged in prohibited practices, we may, subject to applicable law:
    • void Bets and cancel winnings;
    • confiscate Bonuses and associated winnings;
    • close your Account and report the matter to relevant authorities.

Errors, Malfunctions, and Cancellations

  • If a Bet is accepted or a Game operates as a result of a technical error, malfunction, or misconfiguration (including incorrect odds, paytables, or payouts), we may declare the relevant Bet or game round void and reverse any associated winnings, crediting back the stake to your Account where appropriate.
  • In the event of system or network interruptions after a Bet is placed but before it is confirmed or settled, our server logs determine the outcome. If we cannot reasonably reconstruct the outcome, the affected Bet or game round may be voided and stakes returned.
  • We do not guarantee continuous availability of the Website or Games, and we may suspend access for maintenance or security reasons.

Bonus Terms

General Bonus Conditions

  • Bonuses are governed by these Terms and by the specific Bonus Terms published on the Website. In case of conflict, the specific Bonus Terms for a promotion prevail over this section, except where prohibited by applicable law.
  • Bonuses are personal, non-transferable, and may be available only to Users who meet eligibility criteria such as country of residence, registration date, or promotional code use.
  • To activate certain Bonuses (for example, deposit match offers), you may be required to:
    • enter a bonus or promo code when depositing; and/or
    • meet a minimum deposit amount specified in the promotion.

Wagering Requirements and Timeframes

  • Unless stated otherwise in the specific Bonus Terms, Bonus funds and winnings derived from Bonus funds are subject to wagering requirements before they become withdrawable as part of your Real Money Balance.
  • Wagering requirements, including:
    • the total amount that must be wagered;
    • eligible Games; and
    • maximum Bet per spin/round while wagering a Bonus
    • are specified in each promotion's conditions.
    • Wagering requirements must usually be completed within a specified period (for example, 7, 14, or 30 days) from Bonus activation, as indicated in the specific Bonus Terms. If wagering is not completed within the specified timeframe, the Bonus and associated winnings may be forfeited.

    Prohibited Games and Actions

    • Certain Games or categories of Games may:
      • be excluded from contributing to wagering; or
      • contribute only a reduced percentage (e.g., 10% or 20%) towards wagering requirements.
      • These details are outlined in the specific Bonus Terms.
      • We may restrict use of Bonus funds on Games where Bonus abuse risk is high. Attempts to circumvent such restrictions are prohibited.
      • Prohibited Bonus-related activities include, without limitation:
        • placing equal, zero, or low-risk Bets to clear Bonuses;
        • exploiting Game features or Bonus mechanics to guarantee profits;
        • delaying game rounds (e.g., free spin features) to play them after wagering has been completed or funds withdrawn;
        • using multiple Accounts or colluding with others to gain Bonus advantages.
      • Where we reasonably suspect Bonus abuse, we may cancel the Bonus, void associated winnings, and close your Account in serious cases, subject to applicable law.

      Combining Promotions and Bonus Order

      • Unless explicitly permitted in the specific promotion, different Bonuses may not be combined or stacked. Only one active Bonus may apply to your Account at a time.
      • Bonuses may be applied in a particular order (e.g., welcome bonus first, followed by reload bonuses), as explained in the Bonus Terms.
      • If you wish to cancel an active Bonus, you may be able to do so in your Account settings or by contacting customer support. Cancelling a Bonus will normally result in the loss of the Bonus and any associated winnings that have not yet met wagering requirements.

      Payments & Withdrawals

      Deposits

      • You may fund your Account using the payment methods made available on the Website, which may include bank cards, e-wallets, prepaid vouchers, bank transfers, and, where permitted, certain cryptocurrencies or other payment solutions.
      • Available methods depend on your country and may change from time to time. Some payment services may be provided by third-party processors acting on our behalf.
      • We may set minimum and maximum deposit amounts per transaction or per time period. These limits are displayed in the cashier section of the Website.
      • Funds in your Account do not accrue interest. You must use the Website solely for gambling purposes and not as a banking or money transfer facility.

      Withdrawals

      • Withdrawals are generally processed via the same method and to the same account that you used for deposit, where technically possible and permitted by payment providers and regulations.
      • Before processing withdrawals, we may conduct KYC checks as described above. We may refuse or delay withdrawals until all required verification steps are completed.
      • We may impose minimum and maximum withdrawal limits per transaction and over given periods. These limits are displayed in the cashier section or communicated by customer support.
      • Processing times for withdrawals depend on internal review procedures and third-party payment providers. Once we approve a withdrawal, the timing of receipt is largely outside our control.
      • We reserve the right to split large withdrawal requests into multiple payments where required for security, regulatory, or technical reasons.

      Fees, Currency, and Exchange

      • We may charge reasonable fees for certain deposit or withdrawal methods, which are disclosed in the cashier section where applicable.
      • Your Account may be maintained in Canadian dollars (CAD) or other currencies offered on the Website. If your chosen payment method uses a different currency, your bank or payment provider may apply exchange rates and fees, which are your responsibility.

      Refunds, Chargebacks, and Reversals

      • Deposits are generally non-refundable. In exceptional circumstances, and at our sole discretion, we may consider a refund request, provided that:
        • no Bonus abuse has occurred; and
        • no laws or regulations would be breached by such refund.
      • If you initiate a chargeback or payment dispute, we may:
        • charge you for any unpaid amounts and our reasonable costs of handling the dispute;
        • deduct such amounts from your Account balance; and/or
        • close or suspend your Account.
      • We may void Bets, cancel Bonuses, and adjust balances if a deposit is reversed, refused, or charged back.

      Limitation of Liability

      Operator's Obligations

      • We operate the Website under a Curaçao e-gaming licence and aim to provide a fair, secure, and transparent gambling environment.
      • We use licensed and tested software providers, and we seek to ensure that Games are operated in accordance with applicable technical and regulatory standards.
      • We will use reasonable efforts to keep the Website available and functioning correctly; however, we do not guarantee uninterrupted access or error-free operation.

      Exclusions and Limitations

      • To the maximum extent permitted by applicable law:
        • the Website and all services are provided on an "as is" and "as available" basis, without any warranty, representation, or guarantee, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement;
        • we are not liable for:
          • technical failures, interruptions, delays, or errors in the Website or Games;
          • network or internet outages, or failures of your equipment or devices;
          • loss of data, profits, or business arising from your use of the Website;
          • any loss or damage resulting from events outside our reasonable control.
      • Our total aggregate liability to you arising from or in connection with your use of the Website, whether in contract, tort (including negligence), or otherwise, shall not exceed:
        • the amount of the Bet or Wager that gave rise to the dispute; or
        • if the claim does not relate to a specific Bet, the lesser of your net deposits on the Website over the six (6) months preceding the incident and an amount equivalent to CAD 5,000,
        • in each case subject to any mandatory legal rights you may have under the laws of your province or territory.
        • Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.

        Your Responsibility

        • You are solely responsible for:
          • ensuring that your use of the Website is lawful in your jurisdiction;
          • any taxes that may apply to your winnings under the laws that apply to you; and
          • any losses arising from your gambling activities, subject to any mandatory consumer protection rights.

        Intellectual Property Rights

        • All intellectual property rights in and to the Website and its content, including but not limited to text, graphics, logos, trademarks, service marks, trade names, Game content, software, source code, and user interface designs, are owned by us, our affiliates, or our licensors.
        • You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website solely for personal, non-commercial entertainment purposes, in accordance with these Terms.
        • You must not, without our prior written consent:
          • copy, reproduce, modify, adapt, translate, distribute, or publicly display any part of the Website or its content;
          • reverse engineer, decompile, disassemble, or attempt to derive the source code of any software used on the Website, except to the extent expressly permitted by law;
          • use any automated means (robots, scrapers, crawlers) to access the Website or collect data from it.
        • Any unauthorized use of our intellectual property rights is strictly prohibited and may result in civil and/or criminal liability.

        Privacy & Data Protection

        • Your personal data is collected and processed in accordance with our Privacy Policy (or equivalent privacy notice) published on the Website. By using the Website, you acknowledge that you have read and understood the Privacy Policy.
        • The Privacy Policy explains:
          • which categories of personal data we collect;
          • for what purposes we process your data (including KYC, anti-fraud, and responsible gambling measures);
          • with whom we may share your data (such as payment providers, regulators, and game providers); and
          • your rights with respect to your personal data, subject to applicable privacy laws.
        • We take appropriate technical and organizational measures to protect your data, but no online system is entirely risk-free. You are responsible for keeping your login details confidential.

        Changes to Terms

        • We may amend these Terms from time to time, for example to reflect changes in law, regulatory requirements, technical improvements, or modifications to our services.
        • Where changes are material, we will provide reasonable notice by:
          • posting the updated Terms on the Website with a new "effective date"; and/or
          • displaying a prominent notice or banner on the Website; and/or
          • sending an email to the address registered in your Account, where feasible.
        • Continued use of the Website after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Website and may request closure of your Account in accordance with these Terms.
        • The version of the Terms published on the Website at the relevant time applies to your use of the Website at that time.

        Termination & Suspension

        Termination by You

        • You may terminate your relationship with us at any time by contacting customer support and requesting that your Account be closed.
        • Before closing your Account, you should withdraw any available Real Money Balance that is not subject to Bonus or wagering restrictions, subject to applicable verification checks.

        Suspension and Termination by Us

        • We may suspend or terminate your Account and/or restrict your access to the Website where we have reasonable grounds to believe that:
          • you have breached these Terms or any other applicable policy;
          • you have provided false, misleading, or incomplete information;
          • you are underage or otherwise ineligible to use the Website;
          • you have engaged in fraud, money laundering, Bonus abuse, or other illegal or improper conduct; or
          • such action is required for legal, regulatory, or security reasons.
        • Where reasonably possible, we will notify you of the suspension or termination and the reasons for it, subject to any legal or regulatory restrictions.

        Effect of Termination

        • On termination:
          • your right to use the Website and any licences granted under these Terms immediately cease; and
          • we will, subject to any legal obligations or rights to withhold or confiscate funds, pay out any remaining Real Money Balance to you using a suitable payment method.
        • We may withhold or confiscate funds in your Account where lawfully permitted, for example in cases of fraud, money laundering, or serious breaches of these Terms.
        • Termination of your Account does not affect any rights or obligations that have accrued before termination, including any outstanding disputes.

        Governing Law & Jurisdiction

        • These Terms, your use of the Website, and any disputes arising out of or in connection with them are governed by the laws of Curaçao, excluding its conflict-of-laws rules.
        • Any dispute, controversy, or claim arising out of or relating to these Terms or the Website shall, subject to any mandatory provisions of applicable law, be submitted to the exclusive jurisdiction of the competent courts of Curaçao.
        • Nothing in this section limits any mandatory consumer protection rights or other non-waivable rights that you may have under the laws of your province, territory, or country of residence. If such mandatory rights apply, you may be entitled to bring claims in the courts of your place of residence in accordance with those laws.
        • Before initiating formal proceedings, we encourage you to contact customer support to attempt to resolve any complaint or dispute amicably. Details of our complaints handling process are available on the Website.
